Senate Bill 7 is the bill that Senator Owens introduced as a result of his two year DUI Commission. This commission was comprised of many esteemed individuals from the state of Kansas. Judges, legislators, drug and alcohol treatment professionals, an attorney, Kansas Highway Patrol, KBI, DUI Victim Center from Wichita, Prosecutors, DMV and the assistant Attorney General to mention a few that come to mind. This commission worked tirelessly for many collective days of meetings to address issues it felt were imperative to solving the DUI problem in Kansas. One of the first topics that they addressed were life saving ignition interlock devices. The commission as a whole heard testimony from different organizations on ignition interlock devices and their effectiveness at preventing drunk driving fatalities. The chart below shows the lives saved in New Mexico since their legislature enacted mandatory ignition interlock. New Mexico requires mandatory ignition interlock on ALL convicted DUI offenders. Interlocks have been proven by many different independent research studies, including a recent one by the CDC, or Centers for Disease Control. They found that ignition interlock devices are 67% effective in reducing drunk driving recidivism. They are not the only group that supports ignition interlock devices. As can be seen in the above graph from Dr. Roth, in these three measurements of drunk driving, as the use of ignition interlock devices increase all three decrease. Interlocks are an effective tool to prevent future offenses of DUI. The opponent to having ignition interlock required for a first offense is ABI, or Alcohol Beverage Institute. The ABI represent restaurants that serve alcohol, and do not believe in punishing first offenders the same as someone who has had multiple DUI arrests. The ABI is interested in not punishing people for buying alcohol from their clients. During testimony earlier this year on Senate Bill 7, their executive director testified in front of the Senate Judiciary Committee in Topeka. She said that she thought interlocks were an effective tool at preventing drinking and driving, just not for first time offenders. Unfortunately not all of us have our heads buried in the sand on the issue. First offenders have driven on average 87 times before they are caught the first time. This statistic is backed up by the fact that most first offenders become repeat offenders at the same rate as second offenders move on to third. The following graph shows that first offender re-arrest rates are in line with those of multiple offenders in terms of likelihood to reoffend. Catching this trend early is better for public safety, and the offender. Ignition Interlocks give the offender a way to legally drive back and forth to work. Kansas is a very rural state and many have to drive in order to work, go to school, support their family, pay fines, go to treatment as well as many other important aspects to daily life. Interlocks also prevent those with an alcohol issue from reoffending or killing someone. Many states are making the decision to include first time DUI offenders when it comes to their Ignition Interlock sanctions. This article takes 15 scientific studies on ignition interlock into review and determines that ignition interlock devices WILL reduce drunk driving recidivism. Re-arrest rates for alcohol-impaired driving decrease by 67 percent after the ignition interlocks are installed compared to drivers with suspended licenses, said the study by researchers at the Community Guide branch of the Centers for Disease Control and Prevention (CDC). "The very strong indication is that ignition interlocks work extremely well with preventing people with interlocks installed from re-offending," said Randy Elder, scientific director for systematic reviews at Community Guide, commenting on the study. "In order to maximize the benefits of these interlocks in terms of preventing alcohol-impaired driving and crashes, we need to get more people (using them)," The review to be published in the March issue of the American Journal of Preventive Medicine is based upon a systematic review of 15 scientific studies of ignition interlocks

Longer Ignition Interlock, Good For Drivers, Good For Public Safety.Longer periods of ignition interlock may seem like a bad idea to the many DUI offenders required to have them, but I propose a different way of thinking. We all know that individuals that have ignition interlock on their vehicle are up to 95% of the time not going to reoffend. This is an obvious advantage for public safety. But I would say that the advantages to the offender of having the interlock on longer is a huge advantage. While there is a monthly fee to have the ignition interlock device on your vehicle in Nebraska, the advantages are far and above better than the possibility of reoffending. Many times I hear from our customers that they wished they would have just left the device on and they would be in far less trouble. While a small percentage of our clients do choose to keep the device on their vehicle it is definitely not he norm. What could make this situation seem more strange? Well the first driver was 14, and the friend who was going to take the blame was only 16. It was 2:30 a.m. when these two were arrested. While Kansas has the best intentions with mandating permanent license suspension on a fifth or subsequent DUI offense, fact of the matter is, it doesn’t work. If indeed a fifth time offender would get suspended and then never again get behind the wheel of a car, we would never see another 11th DUI offense again. We do though see cases such as these pop up occasionally and this is why permanent license suspension will not ultimately help protect the public from the next Edsel Hess. Unless Edsel is kept behind bars permanently he will most likely, as history has proven, again be caught for DUI. Since 1986 Hess has averaged a DUI about every 3 years. He has been permanently been suspended for the last six offenses. Most like he has spent jail time in each of these offenses, which has not to this point proven to be a successful deterrent. We must take a different approach if we expect to see different results. The Kansas DUI Commission has worked brilliantly in last two years to overhaul the current relevant DUI statutes. One addition to the excellent work they have conducted would be the addition of PERMANENT ignition interlock for drivers after a 5th offense. I do agree whole heartedly that if license suspension worked, it would be fair sanction for this level of offense. Unfortunately it doesn’t and a different solution is warranted. Permanently suspending someone from driving is asking someone to follow a law, when they have already shown many, many times that they have no regard for it. · Ignition Interlock gives a driver a legal way to drive as long as they are sober. · Ignition Interlock provides the driver to be licensed and insured. · Ignition Interlock allows the state and monitoring authorities that the driver is in compliance. · Ignition Interlock can be set to only allow driving to and from work based on time schedules. · Ignition Interlock is proven to reduce recidivism up to 95% while installed on a vehicle. · Ignition Interlock prevents the 75% of suspended drivers who continue to drive from doing it drunk. · Ignition Interlock can provide positive identification of who is taking each and every test. In the case of the wreck that occurred on I-29, Andrew Schlictemeier had been previously arrested for DUI in 2008. Although this was before the new Nebraska ignition interlock law, an interlock just may have saved these peoples lives. Had Mr. Schlictemeier been required to have an interlock he may have shown a pattern for a problem drinker alerting his probation officer to require him to have additional treatment, or extending his period on the interlock device. Potentially the interlock would have taught him that it is not worth even attempting to drive after having a drink. One thing is for sure, whether a drunk driver is “one sip” over the legal limit, or many sips over the legal limit the outcomes can be tragic and devastate lives. I personally believe that the only way anyone ever becomes a multiple offender starts with getting the FIRST. This is where our treatment of the problem needs to begin. If knowing an Ignition Interlock would have prevented this disaster, I’m sure all involved would gladly go back and have one installed.
