Who needs Ignition Interlock in Kansas?

· Anyone who has a 2nd, 3rd, or 4th DUI offense.

· Anyone on a 1st offense for test refusal.

· Anyone who has had a 1st, 2nd, 3rd, or 4th offense, with an alcohol content of .15 or above.

What paperwork will I need?

· You will need a copy of your court paperwork if you are court ordered.

· You will need your state DMV letter if ordered through the Department of Motor Vehicles.

· You will need Ignition Interlock Install/Removal Verification Form.  (We will provide this.)

Concentration of .08 - .14.

 

Offense

 

1. 30 day license suspension, followed by 330 days of restricted driving privileges.  Can drive unrestricted with an ignition interlock device.  Must request to have ignition interlock.  Smart Start can file this request for you.

2. 1 year license suspension.  Followed by one year restricted to ignition interlock device.  Must show proof of completion of your ignition interlock period before you can have full driving privileges reinstated.  On a second offense only, after 45 days of your hard suspension you may apply for an ignition interlock restricted license.  This allows you to drive, under restrictions, during the remainder of the suspension period.  Smart Start can file this request for you.

3. 1 year license suspension.  Followed by one year restricted to ignition interlock device.  Must show proof of completion of your ignition interlock period before you can have full driving privileges reinstated. 

4. 1 year license suspension.  Followed by one year restricted to ignition interlock device.  Must show proof of completion of your ignition interlock period before you can have full driving privileges reinstated. 

5. Permanent license suspension for any 5th or subsequent offense.

 

Concentration of .15 and above.

 

1. One year license suspension.  Followed by one year restricted to ignition interlock device.  Must show proof of completion of your ignition interlock period before you can have full driving privileges reinstated.

2. One year license suspension.  Followed by two years restricted to ignition interlock device.  Must show proof of completion of your ignition interlock period before you can have full driving privileges reinstated.

3. One year license suspension.  Followed by three years restricted to ignition interlock device.  Must show proof of completion of your ignition interlock period before you can have full license privileges reinstated.

4. One year license suspension.  Followed by four years restricted to ignition interlock device.  Must show proof of completion of your ignition interlock period before you can have full license privileges reinstated.

5. Permanent License Suspension.

 

Test Refusal

 

1. One year license suspension.  Followed by one year restricted to ignition interlock device.  Must show proof of completion of your ignition interlock period before you can have full driving privileges reinstated.

2. Suspend two years.

3. Suspend three years.

4. Suspend ten years.
